These Terms of Service apply to all users of EuropaMarketplace, including buyers, sellers, businesses, and visitors.
1. Definitions

Buyer A Buyer is any registered or unregistered user who browses listings, contacts sellers, or enters into transactions with sellers found through EuropaMarketplace.
Listing A Listing is any advertisement, offer, or posting submitted by a Seller and published on EuropaMarketplace, including all associated photos, descriptions, prices, and contact information.
2. Nature of the Platform
EuropaMarketplace operates exclusively as a classified advertising platform and connection service. We do not buy, sell, or exchange any goods or services directly. We do not hold inventory, process payments between buyers and sellers, guarantee the quality or legality of any listed items, or act as a party to any transaction between users.
All transactions are conducted directly and exclusively between buyers and sellers. EuropaMarketplace is not responsible for the outcome of any transaction, the condition of any item, the accuracy of any listing, or any dispute arising between users.
3. Registration and Account
Eligibility To register on EuropaMarketplace, you must be at least 18 years of age and legally capable of entering into binding contracts under the laws of your country of residence. By registering, you confirm that all information provided is accurate, current, and complete.
Account responsibility You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at support@europamarketplace.com if you suspect any unauthorised use of your account.
One account per user Each user may maintain only one active account. Creating multiple accounts to circumvent restrictions, bans, or platform policies is strictly prohibited and will result in the permanent suspension of all associated accounts.
Account termination EuropaMarketplace reserves the right to suspend or permanently terminate any account that violates these Terms of Service, engages in fraudulent activity, or causes harm to other users or the platform, without prior notice and without refund of any fees paid.
4. Listing Rules and Prohibited Content
Seller responsibility Sellers are solely and fully responsible for the accuracy, legality, and authenticity of all content posted in their listings. By posting a listing, you confirm that you have the legal right to sell, rent, or offer the listed item and that all information provided is truthful and accurate.
Prohibited listings The following listings are strictly prohibited on EuropaMarketplace and will be removed immediately upon detection:
Counterfeit, stolen, or illegally obtained goods. Items prohibited under EU law or the national laws of any European country. Weapons, ammunition, or controlled substances. Adult content or services of a sexual nature. Listings that impersonate other individuals, businesses, or brands. Duplicate or spam listings designed to artificially inflate visibility. Misleading or fraudulent offers, including advance fee schemes. Items subject to international trade sanctions or embargoes.
Listing accuracy All prices must be stated in Euros (€) unless otherwise agreed. Listings must accurately represent the item’s condition, location, and availability. EuropaMarketplace reserves the right to edit, remove, or reclassify any listing that does not comply with platform standards.
5. Transactions Between Users
No platform involvement EuropaMarketplace does not participate in, facilitate, guarantee, or insure any transaction between buyers and sellers. All negotiations, agreements, payments, and exchanges are the sole responsibility of the parties involved.
Payment safety EuropaMarketplace strongly recommends that users exercise caution with all payment arrangements. We advise against advance payments to unverified parties, cash transfers to unknown accounts, and the use of non-traceable payment methods such as cryptocurrency or gift cards for high-value transactions.
Disputes Any dispute arising from a transaction between users must be resolved directly between the buyer and seller. EuropaMarketplace does not act as a mediator, arbitrator, or guarantor in any transaction dispute. We will cooperate with law enforcement authorities in cases of reported fraud.
6. Membership and Payments
Membership plans EuropaMarketplace offers paid membership plans that provide access to enhanced features including additional listings, promotional placements, and priority visibility. Current plans and pricing are displayed on the Membership page and are subject to change with 30 days notice to active subscribers.
Billing and renewal Membership fees are billed monthly in advance. Subscriptions renew automatically at the end of each billing period unless cancelled by the user before the renewal date. By subscribing, you authorise EuropaMarketplace to charge your payment method on a recurring basis.
Cancellation and refunds You may cancel your membership at any time from your account dashboard. Cancellations take effect at the end of the current billing period. Membership fees already paid are non-refundable except where required by applicable EU consumer protection law.
Failed payments If a payment fails, your membership features will be suspended until payment is successfully processed. EuropaMarketplace reserves the right to terminate accounts with persistent unpaid balances.
7. Intellectual Property
Platform content All content created and owned by EuropaMarketplace — including the logo, design, software, text, and structure of the platform — is the exclusive intellectual property of EuropaMarketplace and is protected under EU and international copyright law. Unauthorised reproduction or use is strictly prohibited.
User content By posting a listing or any content on EuropaMarketplace, you grant EuropaMarketplace a non-exclusive, royalty-free, worldwide licence to display, reproduce, and distribute that content for the purpose of operating and promoting the platform. You retain ownership of all content you post.
Third-party rights You must not post content that infringes the intellectual property rights of any third party. If you believe a listing on EuropaMarketplace infringes your intellectual property rights, please contact us at support@europamarketplace.com with full details of the claimed infringement.
8. Privacy and Data Protection
EuropaMarketplace processes personal data in accordance with the EU General Data Protection Regulation (GDPR) and applicable national data protection laws. By using the platform, you consent to the collection and processing of your personal data as described in our Privacy Policy, which forms part of these Terms of Service.

9. Limitation of Liability
To the maximum extent permitted by applicable law, EuropaMarketplace shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the platform, any transaction between users, the accuracy or completeness of any listing, any loss of data or business interruption, or any unauthorised access to your account.
EuropaMarketplace’s total liability to any user for any claim arising from the use of the platform shall not exceed the total membership fees paid by that user in the three months preceding the claim.
Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable EU law.
10. Changes to These Terms
EuropaMarketplace reserves the right to update or modify these Terms of Service at any time. Users will be notified of material changes by email or by a prominent notice on the platform at least 14 days before the changes take effect. Continued use of the platform after the effective date of any changes constitutes acceptance of the updated terms.
11. Governing Law and Jurisdiction
These Terms of Service are governed by and construed in accordance with the laws of the European Union and applicable national law. Any disputes arising from these terms or from the use of EuropaMarketplace shall be subject to the exclusive jurisdiction of the competent courts of the country in which EuropaMarketplace is registered.
