1. Acceptance of Terms

By creating an account, posting a listing, purchasing a membership, or simply browsing EuropaMarketplace, you confirm that you are at least 18 years of age, that you have read and understood these Terms and Conditions, that you have the legal capacity to enter into a binding agreement, and that you will comply with all applicable EU and national laws when using the platform.

If you are using EuropaMarketplace on behalf of a business or legal entity, you confirm that you have the authority to bind that entity to these Terms and Conditions.

2. Platform Description

EuropaMarketplace is an online classified marketplace that enables individuals and businesses across Europe to post, browse, and respond to listings for goods, services, vehicles, real estate, employment, and other categories.

EuropaMarketplace does not own, inspect, store, or take possession of any listed items. We do not participate in any transaction between buyers and sellers, do not guarantee the accuracy of any listing, do not verify the identity of users beyond the steps described in our verification process, and do not act as an agent, broker, or intermediary for any transaction. All transactions are conducted exclusively and directly between the buyer and the seller.

3. User Conduct

Acceptable use You agree to use EuropaMarketplace only for lawful purposes and in a manner that does not infringe the rights of any other person or restrict their use and enjoyment of the platform. You are responsible for all activity that occurs under your account.

Prohibited conduct The following conduct is strictly prohibited on EuropaMarketplace and will result in immediate account suspension and may result in legal action.

Posting false, misleading, or fraudulent listings. Impersonating any person, business, or authority. Attempting to collect personal data from other users without their consent. Sending unsolicited commercial messages or spam to other users. Using automated tools, bots, or scrapers to access or extract data from the platform without written authorisation. Attempting to bypass security measures, access other users’ accounts, or interfere with platform infrastructure. Posting content that is defamatory, discriminatory, harassing, or threatening. Listing items that are prohibited under EU law or the national laws of any European country. Creating multiple accounts to circumvent suspensions, bans, or platform restrictions. Engaging in any form of advance fee fraud, phishing, or social engineering targeting other users.

Seller conduct Sellers must ensure that every listing they post accurately represents the item being offered, that they have the legal right to sell or offer the listed item, that all prices are stated in Euros unless otherwise specified, and that they respond to genuine buyer inquiries in a timely and honest manner.

Buyer conduct Buyers must engage with sellers honestly and in good faith, must not make false offers or commitments with no intention to complete a transaction, and must respect sellers’ time and listing terms.

4. Listings

Posting a listing Any registered user may post a listing on EuropaMarketplace subject to the rules in these Terms and Conditions and the listing guidelines published on the platform. By posting a listing, you grant EuropaMarketplace a non-exclusive licence to display, reproduce, and distribute the listing content on the platform and in promotional materials.

Listing accuracy You are solely responsible for the accuracy, completeness, and legality of all content in your listings including title, description, photos, price, location, and contact details. EuropaMarketplace reserves the right to edit, remove, or reclassify any listing at any time without notice if it does not comply with platform standards or these Terms and Conditions.

Listing duration and renewal Listing duration depends on your membership plan or the individual listing package selected. Listings that are not renewed before their expiry date will be automatically deactivated. Deactivated listings can be renewed from your seller dashboard within 30 days of expiry. After 30 days, expired listings are permanently deleted.

Prohibited listings The following items and services may not be listed on EuropaMarketplace under any circumstances: stolen or illegally obtained goods, counterfeit or trademark-infringing products, controlled substances, weapons or ammunition (except where permitted under applicable national law with proper licensing), adult content or sexual services, human beings, organs, or trafficking-related content, items subject to EU trade sanctions or international embargoes, financial instruments or investment products offered without appropriate regulatory authorisation, and any item or service that violates applicable EU or national law.

5. Content Standards

Photos and images All photos uploaded to EuropaMarketplace must be real images of the actual item being listed. Stock images, images downloaded from the internet, or images that do not represent the actual item are not permitted. By uploading photos, you confirm that you own the rights to those images or have explicit permission from the rights holder to use them.

Language and communication Listings may be posted in any European language. All communication between users through the platform’s chat system must remain respectful and lawful. Abusive, threatening, or discriminatory language is prohibited and will result in account suspension.

Moderation EuropaMarketplace uses a combination of automated moderation tools and manual review to monitor listings and user activity. We reserve the right to remove any content that violates these Terms and Conditions without prior notice and without liability.

6. Fees and Payments

Free and paid features Basic listing functionality is available free of charge. Premium features including additional listings, featured placements, top position exposure, boost promotions, and store profiles are available through paid membership plans as described on the Membership page.

Membership billing Membership fees are billed monthly in advance. By subscribing to a membership plan, you authorise EuropaMarketplace to charge your payment method automatically on a recurring monthly basis until you cancel. All prices are displayed in Euros and include applicable VAT where required.

Cancellation policy You may cancel your membership at any time from your account dashboard. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for the unused portion of a billing period except where required by applicable EU consumer protection law, including the 14-day cooling-off right for new subscriptions entered into by consumers.

Promotional credits Any promotional credits, free trial periods, or discount codes are subject to specific terms communicated at the time of the promotion and cannot be exchanged for cash, transferred to another account, or applied retroactively to previous payments.

7. Intellectual Property

All trademarks, logos, platform design, software, and original content created by EuropaMarketplace are the exclusive intellectual property of EuropaMarketplace and are protected under EU and international intellectual property law. You may not reproduce, copy, distribute, or create derivative works from any EuropaMarketplace intellectual property without prior written authorisation.

If you believe that any content on EuropaMarketplace infringes your intellectual property rights, please send a written notice to support@europamarketplace.com including your contact details, a description of the work you believe has been infringed, the URL of the infringing content, and a statement that your claim is made in good faith.

8. Third-Party Links and Services

EuropaMarketplace may contain links to third-party websites or integrate with third-party services. These links are provided for convenience only. EuropaMarketplace has no control over the content, privacy practices, or security of third-party websites and accepts no responsibility for them. Accessing third-party websites from EuropaMarketplace is entirely at your own risk.

9. Disclaimer of Warranties

EuropaMarketplace provides the platform on an “as is” and “as available” basis without any warranties of any kind, either express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free from viruses or harmful components. We do not warrant the accuracy, completeness, or reliability of any listing, user-generated content, or information posted by third parties on the platform.

10. Limitation of Liability

To the maximum extent permitted by applicable EU law, EuropaMarketplace shall not be liable for any loss or damage arising from your use of or inability to use the platform, any transaction between users, reliance on any listing or user-generated content, unauthorised access to your account or data, or any interruption or cessation of platform services.

Nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by negligence, fraudulent misrepresentation, or any other liability that cannot be excluded under applicable EU consumer protection law.

11. Indemnification

You agree to indemnify and hold harmless EuropaMarketplace, its directors, employees, and service providers from and against any claims, damages, losses, costs, or expenses (including legal fees) arising from your use of the platform, your violation of these Terms and Conditions, your listings or content posted on the platform, or any dispute between you and another user.

12. Termination

EuropaMarketplace reserves the right to suspend or terminate your account and access to the platform at any time, with or without notice, if you violate these Terms and Conditions, engage in fraudulent or harmful behaviour, or if required to do so by law. Upon termination, your right to use the platform ceases immediately. Provisions that by their nature should survive termination — including intellectual property rights, limitation of liability, and indemnification — will continue to apply.

13. Modifications to These Terms

EuropaMarketplace reserves the right to modify these Terms and Conditions at any time. Material changes will be communicated to registered users by email or by a prominent notice on the platform at least 14 days before they take effect. Your continued use of EuropaMarketplace after the effective date of any changes constitutes your acceptance of the updated Terms and Conditions.

14. Governing Law

These Terms and Conditions are governed by the laws of the European Union and applicable national law. Any disputes arising from these Terms and Conditions or from your use of EuropaMarketplace shall be resolved in the competent courts of the jurisdiction in which EuropaMarketplace is registered. EU consumers retain the right to bring proceedings in the courts of their country of residence and to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
